MOUNTIAN HOME, Ark. – A federal judge is ordering the Baxter County Courthouse to pay 52- thousand dollars in fees, following the ruling last November that deemed a nativity scene in the courthouse lawn as unconstitutional.
U.S. District Judge Timothy Brooks says the lawsuit cost the county exactly 52,358 dollars in attorney’s fees and in costs to the two plaintiffs, a local businesswoman Dessa Blackthorn and the American Humanist Association. In November, Judge Brooks ordered
Baxter County Judge Mickey Pendergrass to either refrain from putting any seasonal display in the lawn or to take all citizens ideas, faith, and beliefs into consideration for a public display.
According to officials, the court fees will not come from the county directly, but through a third party insurance company.
